PART I – TERMS OF USE OF THE DANIELL’C SITE
This part applies to all users of the Daniell’c website, or any other service available on the Daniell’c website. Please read the terms of use carefully before using the Daniell’c website.
The Site is strictly for personal use. It is forbidden to use the Site or its content for commercial purposes. You agree not to use any document, equipment, and / or procedure, whether automatic and / or manual, to retrieve, monitor, copy the content of the Site or interfere with the operation of the Site, and you agree not to copy, modify or create derivative works from the Site.

NON-COMPETITION
You acknowledge that you may not use the Site to assist in the development or design of a website, computer program, service, software or code that is intended to offer functionality substantially similar to those of the Site.
SUBMISSIONS
For the purposes hereof, “Submissions” means content in digital format submitted or shared with us using the Site; this may include comments you write about a garment.
WITHDRAWAL OF SUBMISSIONS
We reserve the right (a) to refuse to publish or to communicate or to block the access or the use of any Submission by order of a court, judicial order, administrative or by virtue of a power of police, or where we consider it appropriate for reasons of public or individual safety or where we are reasonably inclined to believe that the Bid is unlawful or in violation of these Terms of Use; (b) to the extent that we are permitted to do so under applicable law, to disclose to third parties the name of any User and / or to disclose to any third party any Submissions or Personal Data where this: (i) will facilitate compliance with laws, including, for example, compliance with a court order, or (ii) help to enforce these terms of use (including rules of conduct). We reserve the right to withdraw or refuse to process any Submissions in our sole discretion, whether or not they are denounced, but do not undertake to monitor the compliance with these Terms.
You acknowledge that you are solely responsible for your Submissions and those made by persons under your supervision. You understand and accept the consequences of their display, use or publication. You agree not to transmit or make accessible, directly or indirectly, Submissions containing content that you are not legally authorized to possess, copy, use or distribute, and you agree to fully indemnify Daniell’C for any damages resulting from the inclusion of any Submission on the Site.
Daniell’C does not audit or control the nature of your Submissions. We look forward to your cooperation and honesty in using the Site responsibly.
RULES OF CONDUCT
The following rules of conduct apply to the use of the Site. You agree not to distribute, through your use of the Site, Submission that: (a) is defamatory, abusive, malicious, threatening or constitutes an invasion of the privacy of others; (b) may be seen to be malicious in the eyes of a child or an adult, or racially or otherwise hateful or offensive or contravene the rights of children, may be prejudicial to the person, their image or their integrity; (c) is violent, vulgar, obscene, pornographic or of an explicitly sexual nature; or (d) harms any person or entity or is such that it could reasonably be expected to affect any person or entity; (e) is unlawful or promotes and promotes unlawful activity or the discussion of unlawful activities with intent to commit them, including a Submission that is and represents an invitation to engage in unlawful activity; and (f) violates or violates any rights of any third party, including: (1) copyrights, patents, trademarks, trade secrets and other proprietary and contractual rights; (2) privacy rights; you specifically agree not to release the personal information of anyone of any nature without permission; or (3) any obligation of confidentiality.

Such links, if any, are provided by courtesy, so visiting such websites from the Site should be at your own risk. EXCLUSION AND LIMIT OF LIABILITY
The Daniell’c site is provided “as is” and without any condition or warranty of any kind, whether express or implied, of functionality or of any kind. The legal warranties are hereby expressly excluded. We cannot guarantee that submissions are royalty-free. We do not warrant or make representations regarding the use or results of the use of the site. Our obligation is limited to the withdrawal of any illegal submission and denounced as such. While we are working on data security, we cannot guarantee that the site is secure against intrusion or loss of data. In all circumstances our liability to you is limited to the greater of one hundred Canadian dollars ($ 100.00 cdn) and the amount you may have paid to us in the twelve months preceding any claim.
Although we have made reasonable efforts to ensure compliance with the law, we cannot guarantee that the site complies with all applicable laws in all jurisdictions where it may be used; it is the responsibility of the user to ensure that he can use the site within his jurisdiction.

A. Orders
Before ordering
Each designer has his own style. Our dresses are cut according to specific measurements specific to each designer, therefore, the size that you usually wear may not be the size that suits you to wear for a dress that you choose on our site.
Before choosing your size, we recommend you look at the size chart of the dress you are interested in to make sure you choose the right size for your measurements. To make sure you have found the right size, click on the link “How to choose my size? Next to the dress of your choice.
Coupons & Rebates
A valid Daniell’C discount coupon can be apply to the items you order (excluding sale items) but will not apply to any additional charges, including freight charges.
Notifications
When your order is confirmed, an automatic confirmation email summarizing the details of your order will be sent to you.
The tracking number for your package will be sent to you by a second email once your order is shipped. You can track the shipment of your order using your tracking number at the carrier.

Taxes on Sales
All orders are shipped from Chicoutimi, Quebec, Canada. Applicable sales taxes will be billed.
Payment Methods
Daniell’C only accepts PayPal payments. You can pay with Visa and MasterCard as long as they are registered on PayPal and where PayPal acts as an intermediary.
Paypal is a secure system that allows you to receive and send payments online. Its use is fast, FREE, and will protect you from fraud. For more information, visit www.PayPal.com.
When you make a payment via PayPal, your account authorizes the withdrawal of the total sum of your purchases. If your account is connected to a credit card or bank account, it is possible that funds will be withheld while the transaction is in progress. Your account is debited when your package is shipped, or when you order an item that is not in stock at Daniell’C.
If part or all of your order is canceled (there are significant restrictions on cancellations, see above) the total amount will be charged to your PayPal account, then the amount for the part of the order that was canceled. will be credited in Daniell’C
Crédits Daniell’C
Our Daniell’C Credits apply to all products on our site and have no expiration date. Any remaining balance can be used on another order; however, Daniell’C Credits can not be reimbursed in any way for cash.

B. Order Processing
Hours

shipments
All orders are delivered via Canada Post or DHL, at our option. The shipping cost of shipments is determined by the distance between your delivery location and our warehouse, as well as the weight and size of the package.

Each additional item will add an amount to shipping costs as the size and weight of the package will vary. Delivery delay
For both local, national and international deliveries, the delivery time varies depending on what you order: for example the items we hold in inventory are delivered to the carrier more quickly than those we have to previously order. Signature
All packages require a signature upon reception, and may be subject to taxes, duties and customs fees to be paid upon delivery.
C. Returns
What Can be Return
We want you to be completely satisfied with your purchase, so we accept returns for an exchange or credit, if you are not 100% satisfied, on all our products that were available in stock at the time of your order.
You may not, however, return a special order, an order on request, an item (s) sale (s), a wedding dress or bridesmaid dress (s).
We ask you to send us the items, which can be returned, in perfect condition, with all tags attached or glued to their original place, and the cover intact, and follow the return instructions below.
We are proud to provide quality products and services and value our relationship with you.
Return for an exchange
To exchange an item (which can be returned) that you have ordered for another item, please contact us by email at info@daniellc.com , within 7 days of receiving your order to request your item return authorization (RA #).
Please indicate that you want to redeem your purchase, and specify the name of the designer, the new model (if any), color, size and date you need.
The item must be in perfect condition, with all tags attached or glued to their original place.
Back against credit
Please contact us by email at info@daniellc.com within 7 days of receiving your order to request your Return Authorization Number (RA #). Please indicate that you wish to receive a credit.
The item must be in perfect condition, with all tags attached or glued to their original place.
A Daniell’C credit will be issued once your return is received and inspected.
Merchandise that was shipped directly by us.
Outside of Canada
Whether it’s an exchange or a return for a credit, any taxes, duties or customs fees incurred for the return of orders we have shipped outside of Canada, or for shipping of a replacement item, are not included in the credit and are the responsibility of the customer.
Credit
Once your Daniell’C credit is available for use, we will send you an email with the balance available. Any remaining balance after a transaction will be retained as a Daniell’C credit and cannot be refunded in cash. This credit never expires!
IMPORTANT TO REMEMBER WHEN RETURNING
We remind you that we cannot accept requests for exchange or return of wedding dresses and bridesmaid. These styles are made specifically for you. We recommend that you confirm the model, size, color and any other specification before placing your order. The possible returns must be sent within seven days after receipt of your RA number #.
You can use the carrier of your choice for your return; however, all returns are the responsibility of the customer and the carrier and must be sent by means of a service offering a tracking number and proof of delivery.
Please write clearly in CAPITAL letters your authorization number (RA #) on the outside of the package. All products must be in the condition in which you received them and must be unworn, unused, unwashed and in perfect condition, with the original tags and cover intact, to be accepted as a valid return. All items that appear to have been worn or changed will be rejected and returned to the sender.
All packages returned without an authorization number (RA #) will be subject to a restocking fee of up to 50%.
It takes 4-7 business days for the returns allowed under these terms to be processed. Once processed, the exchange or credit will be indicated on your order. Our credit never expired!
Your satisfaction is our priority. If you are not satisfied for any reason, please let us know and we will do everything we can to satisfy you. Please contact us at 418-973-6414 if you need us to help you with your item return.
LIMITED RESPONSIBILITY
THE PARTIES AGREE THAT DANIELL’C’S SOLE RESPONSIBILITY IS AS DESCRIBED HEREUNDER IN RELATION TO THE RETURNS. ALSO, IN THE THIRTY (30) DAYS FOLLOWING DATE OF PURCHASE, DANIELL’C WILL REPLACE ANY DEFECTIVE ARTICLE SHOULD BE SHIPPED. IN NO EVENT SHALL DANIELL’C’S ENTIRE LIABILITY FOR DAMAGES AGAINST ANY CLAIM CONTRACT OR DELICATESS ARISING OUT OF OR IN CONNECTION WITH THIS LICENSE AGREEMENT EXCEED THE PRICE YOU ACTUALLY PAID FOR THE PURCHASE
GENERAL PROVISIONS
Taxes
Applicable taxes according to the rules in force will be added to the amount of your purchase.
Amendments
We may change this document at any time. Any amendment will be in effect when the modified version is published. In addition, an amendment to the following will apply to sales subsequent to the coming into force of this amendment.
Leniency
No act of tolerance, in respect of a breach of any provision of this Agreement, by any party, by its conduct or otherwise, shall be construed as an abandonment of rights and / or privileges by that party , provided for in any provision herein, unless a proper amendment is made in writing to this Agreement.
Applicable Laws
This Agreement is governed by the laws applicable in the Province of Quebec, Canada. Any dispute shall be brought before a competent court sitting in the district of Montreal, Quebec, Canada.
